Photographs and Testimonials

With customer consent obtained through our Pre-Work Authorization Agreement, the Company may take photographs or video of job sites before, during, and after work. Such media may be used for documentation, training, and advertising purposes. The Company may also use customer testimonials, reviews, or feedback for promotional purposes. Identifiable personal information will not be disclosed beyond first name and last initial without explicit written consent.

Limitation of Liability

To the fullest extent permitted by law, the Company disclaims liability for damages of any kind arising from use of the Site or services, including direct, indirect, incidental, consequential, or punitive damages. Your sole remedy is to discontinue use of the Site.

Indemnification

You agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claims, damages, or expenses (including attorney’s fees) arising from your use of the Site or violation of these Terms.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York and U.S. federal law. Exclusive jurisdiction shall rest with the state and federal courts located in New York.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

 

3. Warranty

Summary

All warranty obligations are governed exclusively by the Pre-Work Authorization Agreement signed before work begins. That Agreement is the controlling legal document.

Scope of Warranty

  • Labor/Workmanship Warranty: Covers workmanship for the period specified in the signed Pre-Work Authorization.
  • Manufacturer Warranties: All pumps, tanks, filters, controllers, and related equipment are covered solely under the manufacturer’s warranty. The Company does not provide any independent equipment warranty

Customer Responsibility

  • If a manufacturer denies a warranty claim, the customer remains responsible for all repair and replacement costs.
  • Warranties are non-transferable. They apply only to the original purchaser and do not extend to subsequent homeowners or property owners.
  • Warranty coverage is void if work is altered, tampered with, or serviced by unauthorized parties.

Exclusions

Warranty coverage does not extend to:

  • Lightning strikes, power surges, flooding, or freezing
  • Neglect, misuse, or failure to maintain equipment
  • Consumable or normal wear items (pressure switches, filters, etc.)
  • Any condition beyond the Company’s reasonable control

Controlling Agreement

This summary is for customer convenience only. In the event of any conflict, the Pre-Work Authorization Agreement signed by the customer prevails and governs.
